Terms of Service
These Terms of Service ("Terms") govern your access to and use of the hosting services provided by ahosting ("ahosting", "we", "us"), through the website ahosting.site and the client area at my.ahosting.site.
By placing an order, creating an account, or using any service, you agree to these Terms. If you do not agree, do not use the services.
1. Definitions
- Service — any virtual private server, dedicated server, IP address allocation, or related product supplied by ahosting.
- Client — the natural or legal person who registers an account and orders a Service.
- Client area — the billing and support portal at my.ahosting.site.
- Billing period — the recurring interval, normally one calendar month, for which a Service is invoiced.
2. Eligibility and account registration
You must be at least 18 years old and legally capable of entering into a binding contract. You must provide accurate and current registration information, including a valid email address, and keep it up to date.
You are responsible for all activity that occurs under your account, including activity by persons you grant access to. Keep your credentials confidential and notify us immediately of any suspected unauthorised access.
We may refuse registration, or suspend an account, where information provided is materially inaccurate or where verification requested under applicable law is not supplied.
3. Services and provisioning
Services are provisioned automatically after an order is placed and payment is confirmed. Provisioning normally completes within a few minutes; we do not guarantee a specific provisioning time.
Each Service includes the resources stated on its product page at the time of ordering — virtual CPU cores, memory, NVMe storage, network port speed, and IPv4 address allocation. Resource specifications may be revised for new orders; existing Services keep the specification they were sold with for the duration of the current billing period.
Unless expressly stated otherwise, Services are unmanaged. You are responsible for the operating system, all software installed on it, its configuration, its security, and its data.
4. IP addresses
IP addresses are assigned to a Service for the duration of that Service and remain the property of ahosting or its upstream provider. They are not sold and are not transferable.
We may reassign or renumber an IP address where required for network operation, by an upstream provider, or by a competent authority. Where practical, we give advance notice.
Where an IP address becomes unusable through no act of the Client — for example, inclusion on a third-party blocklist due to a prior holder — we will issue a replacement address on request at no charge. Where an address becomes listed as a result of the Client's own use, replacement is at our discretion and may be refused.
5. Acceptable use
You must not use a Service to conduct, host, or facilitate any of the following:
- Any activity unlawful under the laws of the jurisdiction in which the Service is hosted, or under the laws applicable to you.
- Unsolicited bulk email, unsolicited commercial messaging, or operation of infrastructure supporting such messaging.
- Port scanning, denial-of-service attacks, brute-force attempts, network intrusion, or deployment of malware, ransomware, botnets, or command-and-control infrastructure.
- Child sexual abuse material. This results in immediate termination without notice and, where required, referral to the competent authorities.
- Phishing, carding, fraudulent payment processing, or the sale of stolen credentials or data.
- Distribution of copyright-infringing material where we receive a valid and substantiated notice.
- Cryptocurrency mining, on any plan, without prior written agreement.
- Any activity that materially degrades service for other clients or threatens the stability or reputation of our network.
We do not monitor the content of client servers as a matter of routine and act on receipt of a substantiated report or where automated network monitoring indicates abuse.
6. Fees, invoicing and payment
Prices are stated on the product page and in the client area, in euro, and are exclusive of any tax that may apply to your jurisdiction. Recurring Services are invoiced in advance of each billing period.
Invoices are issued to the client area and by email. Payment is due by the invoice due date. We accept the payment methods offered at checkout, which may include payment card, bank transfer, and cryptocurrency.
Cryptocurrency payments are credited on confirmation by the payment provider. Where the amount received differs from the invoiced amount because of exchange-rate movement or network fees, the shortfall or surplus is applied to the account balance.
7. Late payment and suspension
| Stage | Timing | Effect |
|---|---|---|
| Invoice issued | 7 days before period start | Payable on receipt |
| First reminder | Due date | Service continues |
| Suspension | 3 days after due date | Service stopped; data retained |
| Termination | 14 days after due date | Service and all data deleted |
Suspended Services are restored on payment of the outstanding balance. Data on a terminated Service is deleted irrecoverably and we are unable to restore it.
8. Cancellation and refunds
You may cancel a Service at any time from the client area. Cancellation takes effect at the end of the current billing period unless immediate cancellation is requested.
Refunds are governed by our Refund Policy, which forms part of these Terms.
9. Service availability
We target 99.9% network availability measured monthly, excluding scheduled maintenance announced at least 48 hours in advance, and excluding downtime attributable to the Client's own configuration, software, or actions.
Where monthly availability falls below the target as a result of a fault on our side, you may request a credit to your account, calculated pro rata against the affected Service's monthly fee for the period of the outage. Credit is applied to the account balance and is not paid out in cash. Claims must be submitted within 30 days of the incident.
10. Backups and data
Unless a backup product is expressly purchased, no backup of your data is taken. You are solely responsible for maintaining your own backups, stored independently of the Service.
You retain all rights in the data you store on a Service. We access it only where necessary to operate or repair the Service, to respond to a support request you have made, or where required by law.
11. Suspension and termination by us
We may suspend or terminate a Service where there is a breach of section 5, where an invoice remains unpaid under section 7, where continued operation threatens the security or stability of our network, or where we are required to do so by a competent authority.
Except in cases of serious abuse or legal compulsion, we give notice and, where circumstances permit, an opportunity to remedy the breach before terminating.
12. Liability
Services are provided on an "as is" basis. To the extent permitted by law, we exclude all implied warranties, including fitness for a particular purpose.
Our total liability arising from or connected to a Service, in any twelve-month period, is limited to the amount paid by you for that Service in the three months preceding the event giving rise to the claim.
We are not liable for loss of profit, loss of business, loss of data, or any indirect or consequential loss. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Changes to these Terms
We may amend these Terms. Material changes are notified by email and in the client area at least 30 days before they take effect. Continued use of a Service after that date constitutes acceptance. If you do not accept a change, you may cancel before it takes effect and receive a pro-rata refund of any prepaid period.
14. Governing law
These Terms are governed by the laws of the State of New Jersey, United States. Disputes are subject to the exclusive jurisdiction of the courts of that state, save where mandatory consumer-protection law grants you the right to bring proceedings elsewhere.
15. Contact
Questions about these Terms should be sent to support@ahosting.site or raised as a ticket in the client area. Contact details are on the contact page.
